Section 504 of the Americans with Disabilities Act
-
Section 504 requires the needs of students with disabilities to be met as adequately as the needs of students without disabilities. A student may have a learning-, behavior-, or health-related impairment that substantially limits one or more major life activity. A referral may be made to the School Building Level Committee (SBLC) to request a Section 504 Evaluation. The committee must gather a preponderance of evidence to determine eligibility. A single source of information (such as a doctor’s report) cannot be the only information considered. In considering substantial limitations, students must be measured against their same age, non-disabled peers in the general population. A student found to be eligible under Section 504 may receive accommodations in order to be afforded equal access to educational opportunities. The ultimate goal of education for all students, with or without disabilities, is to give students the knowledge and compensating skills they will need to be able to function in life after graduation.
